Challenge
In a situation where litigation is reasonably anticipated, the legal hold process encompasses the steps necessary to preserve all forms of relevant information, which typically includes large volumes of both electronic and paper-based data collected from many custodians. The actions necessary to accurately identify and notify affected parties can be both overwheilming and time consuming.
Organizations are faced with the challenge of distributing legal hold notices and interview question sets to custodians and tracking their compliance and responses to questionnaires. The use of several software products, such as spreadsheets, locally-saved documents and individual e-mail accounts can be tedious and disorganized and leaves too much room for error and oversight.
When an organization is confronted with pending or potential litigation or investigation and needs to ensure that electronic and hardcopy information is neither changed nor destroyed, they need a centralized system to facilitate the process.
Solution
kCura teamed up with Milyli to architect a solution to address and overcome these challenges. Through this partnership, Method, kCura's Legal Hold Management solution, was built. Together with kCura, Milyli gathered requirements from top law firms to determine how the ideal solution would perform. From there, kCura and Milyli analysed the requirements and designed a system that would meet the needs of the industry.
Method is a flexible, web-based application built on top of the Relativity platform, giving users the familiar look and feel of Relativity along with the tools necessary to handle even the most complex of legal holds. Using highly customizable templates and repeatable workflows, Method allows users to distribute e-mail based legal hold notices, conduct interviews of custodians to gather crucial information, track and analyze responses, and generate reports that allow for the auditing of all communications with custodians and other legal hold participants. This provides organizations with an efficient, defensible and cost effective solution to manage the legal hold process.
